Terms and services

ServCity powered by Blockchain Creek will be further mentioned as ServCity in this document.

1. Ordering

1. The customer is not obliged to make the payment after placing an order.
2. The customer is not committed to anything and can stop paying at any time.
3. Orders will be delivered within the advertised indication on our website, unless there is not enough stock.
4. If the server turns out to be out of stock, it will be delivered within 8 days else a refund will be processed.
5. ServCity will do its utmost to ensure that there is always enough stock.
6. Pre-orders can't be refunded

2. Game server

1. If the consumer does not renew the server, ServCity is authorized to shut down the server after it has been expired.
2. If the consumer does not renew the server, ServCity is authorized to remove all data of this server, 3 days after the server is expired.
3. Support with regard to plugins/resources and code is not guaranteed.
4. ServCity is not responsible in case of data loss. The customer is responsible for making backups.
5. The fair use policy for Storage is 10GB Storage per 1GB of ram. More may be requested, and will be decided on a case-by-case basis.
6. The fair use policy for Bandwidth is: 100GB/month/(GB of RAM rented). The enforcement of that Limit will be decided on a case-by-case basis based on the impact it has on the network.
Examples for these lower impact usecases are usage of bandwidth only during off-peak times, or usage of only cheaper destinations. You can easyly lower your network consumption by using xcord as proxy instead of other alternatives.
7. Whilst the Servers are allowed to be used to proxy to non-servcity Servers, this traffic counts towards your fair-use-Traffic.
Bandwidth from proxies to Servcity hosted servers is not counted if within the same Region. We will inform you if you are over the Fair-use soft-limit.

3. VPS

1. The customer is not allowed host or run any websites/programs that are prohibited under law. Such as performing DDoS attacks, hosting child porn content and hosting copyrighted content.
2. The customer is not allowed to send spam from his ServCity servers.
3. ServCity is not responsible in case of data loss. The customer is responsible for making backups.
4. ServCity will not provide support for third-party apps but sometimes we can put you in the right direction.
5. ServCity is allowed to suspend the server if there is any kind of illegal acitvity on the server.
6. It's not allowed to mine crypto on a VPS.
7. With a virtual server you share CPU performance with other customers, therefore it's not allowed to use the CPU heavility for extended periods of time (Fair use).
8. It's not allowed to use your VPS as a proxy or tunnel traffic to a server outside our network.

4. Dedicated servers

1. The customer is not allowed to host illegal programs, content or websites.
2. The customer is not allowed to send spam from his ServCity servers.
3. ServCity is not responsible in case of data loss. The customer is responsible for making backups.
4. ServCity will not provide support for third-party apps but sometimes we can put you in the right direction.
5. ServCity is allowed to suspend the server if there is any kind of illegal acitvity on the server.
8. It's not allowed to use your Dedicated server as a proxy or tunnel traffic to a server outside our network.

5. Support

1. The customer can open a ticket in our Discord server or send us an email to support@ServCity.org, if he has any questions regarding his service.
2. The official (non-SLA) response time of ServCity is 24 hours. But in practice this can of course be a lot faster.
3. ServCity only offers support on the services provided by ServCity.
4. ServCity does not provide support for third-party software.

6. Refunds

1. By placing an order, the customer accepts that ServCity does not accept any refund request that isn't covered by our refund policy.
2. The customer is entitled to a refund if the services of ServCity have an availability of less than 99%, caused by technical issues on our side.
3. Downtime not caused by ServCity such as a misconfiguration made by the customer does not count.
4. The customer needs to report a technical issue the the ServCity support via the #create-support-ticket channel in our discord server and give ServCity enough time to fix the issue.
5. A refund will be denied if the reason for the refund is: "I don't know how it works". The customer is responsible for installation and configuration of any programs or plugins in his server.
6. A refund will be processed within 7 business days.
7. Some countries have a legal period in which the customer can terminate their server without giving any reason. The customer then gets his money back. This is called Right of withdrawal (or herroepingsrecht). By placing an order with ServCity, you agree to waive this right.
8. The customer may not refund the payment, through payment services such as paypal by submitting a claim. They must always request a refund via the ServCity support.
9. If the customer opens a claim with paypal or opens a dispute at the creditcard provider, ServCity may immediately stop and delete the services of the customer without warning.

7. Other obligations of ServCity

1. ServCity is not responsible for the content that the customer is hosting.
2. ServCity will remove illegal content or other illegal applications/scripts that are not permitted by law.
3. ServCity is not responsible for data-loss in any case.

8. Force of the majority

. None of the parties is obliged to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure means in any case: war (danger), riots, strikes, war, fire, water damage, flooding, atmospheric conditions, prolonged power outages, adjustments or maintenance to the telecommunications network and / or electricity network of others, cable breaks, attacks on a network / server including DDoS and DoS, disruptions in the networks important for ServCity, disruptions in communicative connections including telecommunication connections or prevention or refusal / prolonged absence of compliance by suppliers on whom ServCity depends on the performance of its work is.

9. Changes in the terms and services

1. ServCity is allowed to change the terms and services at any time.
2. ServCity has to announce every change in the #announcements channel in it's Discord server.

10. ServCity Community Support

1. ServCity is not responsible for any of the actions taken
2. ServCity is not responsible for data-loss in any case.
3. ServCity is allowed to change the terms and services at any time.
4. ServCity does not provide support for third-party software.
